Who is at Risk of Asbestos Related Illness?

Asbestos is no longer used in industry, so most cases involve people who used to work in the building and construction trade, particularly in the 1970’s to 1990’s. While asbestos is no longer actively used today, people working in old buildings that may have asbestos remaining within the structure (such as electricians and construction workers), can disrupt the fibres and face exposure.

While primary asbestos exposure often involves working directly with asbestos, secondary and environmental exposure is also a possibility and potential grounds for a claim. Secondary exposure involves living with a family member who has been exposed and brings home fibres on their clothes, skin or hair. Environmental asbestos exposure is living in the vicinity of an asbestos factory, for example. These types of exposure are less likely to cause severe illness, although if it does, you may be eligible to claim.

How to Make a Claim

What if the Person has Died From the Illness?

If the person has died from an asbestos illness but the illness was diagnosed within the last three years, you can claim on their behalf. Likewise, if the person dies during the middle of a case, their family can continue it on their behalf.

What if the Company is No Longer Trading?

While the cause of asbestos related diseases can occur decades before, the symptoms may not start to unveil until much later. Often this means companies who were negligent have ceased trading. This does not affect your claim, compensation can still be sought from the company’s liability insurers.
